Concept Note

16th of December, 2012 changed something in the Indian Conscience. A rape so horrific that it lead to the victim’s intestines being pulled out by the perpetrators forced the people of this country to move to the streets and demand change in the laws of this country. This led to the Criminal Law (Amendment) Act, 2013 which amended the Indian Penal Code, the Code of Criminal Procedure, the Indian Evidence Act and the Protection of Children from Sexual Offences Act, 2012. It’s been almost six years, a lot has changed or has it?

The Criminal Law (Amendment) Act, 2013 brought some sincere changes in the legal framework like allowing the right to private defence to the extent of causing death for reasonable apprehension of Acid Attack, inserting the offence of  Acid Attack, extending the punishment for assault or criminal force with intent to outrage modesty, insertion of offences like stalking and voyeurism, substitution of new sections for trafficking of person, rape with focus on consequences to determine punishment, sexual intercourse with a person in authority, as well as provisions related to gang rape.

Now, almost six years down the line it is important to look back and introspect and look forward and predict. The need of the hour is to actually analyze how effective these laws have been through solid parameters like crime statistics, conviction rates and recurrence of such incidents and on the basis of that decide what best new laws can be framed and amended. Society is dynamic and if we sit on our laws without the prospect of change it would take such horrific heart wrenching incidents to affect the change that is requisite.
