SC orders probe into counter allegation in the jail superintendent molestation case

Shamesher Singh Dahiya, the jail superintendent of Hissar jail is facing a molestation case in the Supreme Court by a women prisoner. A bench headed by Chief Justice JS Khehar Justices D Y Chandrachud and S K Kaul of the Supreme Court today directed the Haryana Police to probe into the statement given by Dahiya, that he was not involved in this and this could be established by the CCTV footage. According to Dahiya, he was at home at the time which has been mentioned in the FIR. The case was registered in July 30th, 2015. “It cannot be presumed that the person is guilty just because he is a Jail Superintendent. Any investigation has to be balanced. It has to be a both-sided investigation, “Senior Advocate Indira Jaising appearing for the women inmate requested the Court direct any other agency but not Haryana Police as because Dahiya is a part of it. Many police prisoners have filed complained against this IPS officer and so far no action has been taken. Her submission was declined by the bench. The women denied for recording her statement before a judicial magistrate due to which police sought for closure of the case at the local court. Besides seeking CBI probe, the plea had said the inmate be produced in the apex court “to enable her to make a statement before the magistrate with regard to her sexual molestation by respondent no. 3, the Jail Superintendent, Central Jail Hissar.”
