The Supreme Court would hear the plea of Delhi Government for setting up Constitution Bench of at least 5 Judges against the verdict passed by Delhi High Court in August, 2016 deciding the Lieutenant Governor as the administrative head of Delhi. The matter was referred to the bench headed by the Chief Justice of India, JS Khehar, Justice DY Chandrachud and Justice SK Paul by the Delhi Government’s senior advocate Gopal Subramaniam. Justice JS Khehar said, “We will see whether it will come up before or after summer vacations”. The Advocate told the bench that this matter has been referred to a five Judge Constitution Bench and had been acknowledged by the Court as an urgent matter. Earlier, Justice AK Sikri and RK Agarwal decided to refer the matter to Constitution Bench of five judges because this issue involved the interpretation of Art. 239AA.
