The Supreme Court ordered a five judge constitution bench to examine the matter on triple talaq during the summer vacations from May 11 to 19. When objections were raised by the advocates on working of the Court during the summer, Chief Justice Khehar said, “There are three important issues we are taking up during the vacation. These are matters pending and if you don’t want us to take them up, then don’t say huge pendency of cases in the Supreme Court. If we don’t take up these cases, they will be pending for year”
On February 16 the Apex Court had asked the parties to file their written submissions to which the The All India Muslim Personal Law Board filed in its written submission “It is humbly submitted that the court ought not to venture into the area of changing personal laws by following the trend in several other countries. It is pertinent to note that any change or reform that comes with the backing of legislature takes due care of diverse cultural background, sensitivity and sensibility of the stakeholder community and thus is in spirit adheres to both the principles — the principle of democracy and the principle of separation of powers,”.
